Concordat policy of Bavaria: from the Napoleonic Wars to the Weimar Republic
Abstract
The article examines the relations between Bavaria and the Holy See in the period 1802–1925 (from the secularization in Bavaria to the entry into force of the second Bavarian Concordat) in the context of concordats between them. Bavaria had a leading role in the history of concordats between the Holy See and the German states in the 19th and 20th centuries. This applies both to the Concordat of 5 June 1817 between Pope Pius VII and King Maximilian I Joseph of Bavaria, and to the Concordat of 29 March 1924 between Pius XI and the State of Bavaria. The reasons and circumstances leading to the agreements are shown. This article aims to reflect the significance of the signed treaties for Bavaria, Germany and the Catholic Church. Because of the Bavarian government's claim to supremacy in matters of religion, the Concordat of 1817 was limited by the religious edict of 1818, which subordinated the church to the state. As a result, church-state relations in Bavaria until 1918 became dependent on the political and ecclesiastical position of the king and the government. The Concordat of 1924, based on the Weimar Constitution of 1919, was beneficial to both sides: it served as a symbol of independence for Bavaria from the central government in Berlin and guaranteed the Catholic Church influence in education and control over the appointment of bishops. Still active this concordat has made a significant contribution to the development of German church-state law, becoming the model for the regulation of relations between the Catholic Church and the German states in the 20th century.
